I don't know what hypotheses you are assuming in that Lemma, but the converse doesn't hold in general. For instance, for $R=K[X,Y]$ (eventually localized at $(X,Y)$) and $M=R/(XY)$.

The result you mentioned as a Theorem is also well known. (I forgot to mention it in my question.) The point was if one can test the flatness involving only the maximal ideal.
