Jan 21, 2014 at 8:39 comment added user76758 @LaurentMoret-Bailly: Oops, I must have had in mind the additional (necessary) condition that the $\overline{k}$-points over $x$ are all in the same $G_{\overline{k}}$-orbit. I should think it through again, but that would appear to take care of your suggested counterexample.
